If a material defect is incapable of correction or if Verizon Online determines in its sole
discretion that it is not practical to repair or replace the defective hardware, the price paid
by Customer for the defective hardware will be refunded by Verizon Online upon return
to Verizon Online of the defective hardware. All hardware (or part thereof) that is
replaced by Verizon Online, or for which the purchase price is refunded, shall become
the property of Verizon Online upon replacement or refund. Limited Software Warranty:
Verizon Online passes on to Customer the warranty of the Licensor that the software
portion of the Product (“Software”) will substantially conform to the Licensor’s then
current functional specifications for the Software, as set forth in the applicable
documentation, from the date of Customer’s purchase of the Software for a period of
ninety (90) days (“Software Warranty”) DIRECTLY OR INDIRECTLY, TO THE LIMITED
WARRANTY. Except as otherwise required by law, including New York laws relating to
consumer transactions, any cause of action or claim Customer may have with respect to
the Product must be commenced within one (1) year after the claim or cause of action
arises or such claim or cause of action is barred. Some states do not allow exclusion or
limitation of incidental or consequential damages or limitations on how long an implied
warrant lasts, so the foregoing limitations and exclusions may not apply. This Limited
Warranty provides specific legal rights and the product owner may also have other rights
which vary from state to state.
